The Florida Department of Health, CDC, public health and regulatory officials in several other states, and the U.S. Food and Drug Administration (FDA) are collecting different types of data to investigate a multistate outbreak of Listeria monocytogenes infections. As a result of this investigation, Big Olaf Creamery in Sarasota, FL, is voluntarily contacting retail locations to recommend against selling their ice cream products. Consumers who have Big Olaf Creamery brand ice cream at home should throw away any remaining product.

Public health officials continue to interview people about the foods they ate in the month before they got sick. Of the 17 people interviewed, 14 (82%) reported eating ice cream. Among 13 people who remembered details about the type of ice cream they ate, six reported eating Big Olaf Creamery brand ice cream or eating ice cream at locations that might have been supplied by Big Olaf Creamery.

On July 1, 2022, Big Olaf Creamery in Sarasota, FL, voluntarily began contacting retail locations to recommend against selling their ice cream products. Consumers who have Big Olaf Creamery brand ice cream at home should throw away any remaining product.

Public health officials continue to interview people about the foods they ate in the month before they got sick. Of the 17 people interviewed, 14 (82%) reported eating ice cream. Among 13 people who remembered details about the type of ice cream they ate, six reported eating Big Olaf Creamery brand ice cream or eating ice cream at locations that might have been supplied by Big Olaf Creamery.

As of June 29, 2022, a total of 23 people infected with the outbreak strain of Listeria monocytogenes have been reported from 10 states. Of the 22 people with information, 20 sick people reported living in or traveling to Florida in the month before they got sick, although the significance of this is still under investigation. Illnesses started on dates ranging from January 24, 2021, through June 12, 2022.

Sick people range in age from less than 1 to 92 years, with a median age of 72, and 52% are male. Twenty-two people (96%) have been hospitalized. Five people got sick during their pregnancy, and one illness resulted in a fetal loss. One death has been reported from Illinois.

Who supplied the Tara and what is the likely contaminate or toxin is causing the illnesses? What say you FDA, Daily Harvest and Revive?

Over the last week, I have spoke to and been retained by over 160 people linked to the consumption of Daily Harvest products – specifically, the French Lentil + Leek Crumbles. This is a very interesting and tragic outbreak – nearly identical acute symptoms – abnormal liver enzymes and bilirubin, many with gallbladder involvement.  Many have had multiple blood tests, MRIs, CTs, ultrasounds, liver biopsies and gall bladder removals.  No positive clinical (human) test for a causative agent has yet to be determined.  We are testing about 40 samples of the common food product – Daily Harvest French Lentil + Leek Crumbles.

One thing we have learned from reviewing all the product ingredients is that the Daily Harvest French Lentil + Leek Crumbles share one ingredient that other Daily Harvest products do not – Tara.

Two weeks ago I tried the crumbles for the first time. That night, I had debilitating stomach pain, like nothing I had ever felt before. It was so bad I had to go to the ER as a last ditch effort to alleviate and manage the pain. After a CT scan, IV, meds, and a week on a bland diet I thought perhaps it was some sort of bug.

Several days later I tried a flatbread from them and had a fever the next day. I thought it was related to the previous bout of illness.

Fast forward to yesterday, I decided to try the crumbles again. Lo and behold I am awake with the exact same horrible stomach pain. Luckily I have prescription meds from the last time this happened and do not need to go back to the ER.

The crumbles were the ONLY common denominator between the last stomach ache and this one. I believe this product has caused me debilitating stomach pain that has taken days to go away.

Has anyone ever experienced something like this with the crumbles? And new buyers… maybe beware.

EDIT 6/17: Unfortunately a few hours after making this post I also came down with a fever of 101.8 that lasted over 12 hours despite me taking an NSAID. I also had severe muscle cramps and have been experiencing dark urine for 2+ days. I will be going to a doctor tomorrow for lab tests, just in case.

MY STORY ABOUT REVIVE SUPERFOODS AND LIVER ISSUES

After hearing the Daily Harvest Lentil crumbles story I was shocked. I went through the exact same thing. In March I drank multiple Revive Superfoods smoothies in a week. I began to experience nausea which led to the worst pain of my life to the point where an ambulance was called. I was rushed to the hospital screaming in pain and was given fentanyl because of how extreme this pain was. I was given a cat scan and told that my liver looked terrible and that I was in liver failure. My liver and gaulbladder were inflamed and had fluid around them. I was in complete shock as I am a healthy woman in my 20s. They were seriously discussing a liver transplant. My liver enzymes were out of this world 400 500 600s. ALT and AST. Billyrubin was elevated at points. It was a mess. I thought I was going to die. I was discharged after 4 nights because they didn’t know what was wrong with me and why my liver enzymes were elevated. I had to go back to the hospital again a couple days later due to more pain and was in there for another 5 nights and had a liver biopsy. Then the Month of April went by and I took it very easy as no one had any idea what was wrong with me. I then began little workouts again in May and drank some revive superfoods smoothies. I felt sick again with this dull back ache and stomach pains and I had a 102 degree fever. Sure enough when I got back to the hospital, my liver enzymes were climbing again. I had to get an endoscopy, and even after I was released I had to go back AGAIN because of the pain. At this point they gave me oxy to take home because they had no idea why I had these issues and they wanted me to be able to manage the pain. I missed a lot of work due to this. I missed months because I could not work consistently. I went through so much emotional and physical pain, I am still not living a normal life because of this. I could hardly walk. I was so fatigued and still experience this fatigue. Until the Daily Harvest story came out I thought I was alone. It never crossed my mind that a food could have done this to my body. Much less a food that was supposed to be healthy. If anyone else has had this happen with Revive Superfoods please share your story so that we can raise awareness

The same exact thing happened to me! I’m based in Dubai and they recently expanded into the market here. I started consuming Revive Superfoods smoothies at the end of March and had 3 separate episodes of elevated liver enzymes (ALT & AST hitting the 700s / 800s; normal range is 30-32), jaundice, elevated bilirubin, fever, dark urine, severe abdominal pain, enlarged/inflamed liver and swollen abdomen. I was hospitalized for 4 days in April but discharged when all the viral, bacterial and parasite tests came back negative. My liver enzymes started normalizing (but were still very elevated) so they asked me to come back for weekly testing to track progress.

This affected the way I live my life and what I consume. I spent countless of hours in and out of doctors offices after being hospitalized to run several tests. The doctors were still unable to conclude a reason for my illness so I’ve been really careful with what I’m eating to be safe. As a result of my illness I’ve also had other health complications which I won’t get into as it’s pretty private (but devastating nonetheless).

I began suspecting RS smoothies so stopped consuming them completely towards the end of May. The last day I had a smoothie was 20 May and I had a liver episode the same night. Now that the DH news is out, I finally connected the dots. It’s scary that so many people went through exactly the same experience I did and still don’t have answers.

Both DH lentil + leek crumbles and the RS smoothie I had share the same ingredient: Tara Protein.

I want to spread awareness about this to help others avoid what I’ve been through. It was horrible and I wouldn’t wish it on anybody.

Interestingly, Revive just recalled products in Canada due to Norovirus – which would not account for the illnesses described.

So, the question remains – who supplied the Tara and what is the likely contaminate or toxin is causing the illnesses? What say you FDA, Daily Harvest and Revive?

Natural ingredient from Peru

A wide range of hydrocolloids and stabilizers are used in the food and beverage industry to perform a range of technological functions and offer innovative products answering to consumer’s needs.
Tara gum is a natural additive, obtained by grinding the endosperm of the seeds of Caesalpinia spinosa, of the Leguminosae family. Tara gum, also called Peruvian carob, is a white to yellowish powder which is soluble in hot water and partially soluble in cold water.

Chemically, tara gum is comprised of polysaccharides, mainly galactomannans, of high molecular weight.

Tara gum is approved as a food additive by the Food Chemicals Codex and functions mainly as a thickener and stabilizer.

Nature from South America

Caesalpinia spinosa is a shrub or tree that can reach a height of 8 meters with spreading, grey-barked leafy branches. The leaves are compound, bipinnate, alternate and spirally organized and reach a length of 35 cm. The fruit is a flat oblong indehiscent reddish pod which contains 4 ~ 7 large round black seeds composed of endosperm (22% by weight), germ (40%) and hull (38%).

The tara tree is native to the Cordillera region of Peru and Bolivia in South America, where the fruit grows from April to December. Tara trees grow at up to 3,000 meters above sea level and tolerate dry climates and poor soils including those high in sand and rocks. The tree is also resistant to most pathogens and pests. Mature pods are usually harvested by hand and typically sun dried before processing.

Revive Organics Inc. is recalling certain smoothie and oat products from the marketplace because of possible norovirus contamination of the raspberries used in these products.

This recall was triggered by Canadian Food Inspection Agency test results.

The recalled products have been sold nationally in Canada and online.

The FDA, along with CDC and state and local partners, is investigating consumer complaints of gastrointestinal illness and abnormal liver function that may be attributable to eating Daily Harvest French Lentil & Leek Crumbles frozen product.

On June 17, 2022, in response to consumer complaints submitted to the company, Daily Harvest voluntarily initiated a recall of their French Lentil & Leek Crumbles. In response to Consumer Adverse Event Reports (CAERS) and Consumer Complaints submitted to the FDA, the FDA has initiated an investigation, including an inspection and sample collection in an effort to determine the cause of illnesses. As of June 28, the FDA has received 133 CAERS reports and Consumer Complaints related to this product.

From April 28 to June 17, 2022, approximately 28,000 units of the recalled product were distributed to consumers in the continental United States through online sales and direct delivery, as well as through retail sales at the Daily Harvest store in Chicago, IL, and a “pop-up” store in Los Angeles, CA. Samples were also provided to a small number of consumers.

Daily Harvest emailed consumers who were shipped the affected product, and other consumers for whom the company had contact information and consumers were issued a credit for the recalled product. Consumers who may still have the recalled product in their freezers should immediately dispose of it.

FDA’s investigation is ongoing, and more information will be provided as it becomes available.

Consumers should not eat, sell, or serve recalled products. Consumers who may still have the recalled product in their freezers should throw it away.

If you experience symptoms including yellowing of the skin and eyes (jaundice), dark urine, itching with no rash, gastrointestinal illness, nausea, fatigue, body aches, severe abdominal pain and/or fever after consuming this product, please consult with your healthcare provider. Let your healthcare provider know you have recently consumed the recalled Daily Harvest French Lentil & Leek Crumbles. Healthcare providers should report these illnesses to their health department.

Although the FDA does not out Daily Harvest by name, over the last week I have directed over 100 people to report their illnesses to the FDA. Of note is that a recall was initiated and the only frozen food recall in the last week has been the Daily Harvest French Lentil + Leek Crumbles.

Since this outbreak broke (thanks to social media – TikTok, Instagram, Twitter and various online platforms – Reddit), we have been contacted and retained by over 125 people – mainly women between the ages of 25-45. They are all active, health conscious and sick with nearly identical symptoms of acute liver failure. Collectively, their liver function tests were extremely elevated. Some have dropped and some have not. At lease 20 people have endured their gall bladder being removed. All are worried about the long-term impacts on their health by an ingredient causing the illness, that to date has not been determined after extensive blood work, imaging and live biopsies.

Thankfully, many of the people did not take Daily Harvest’s advice and throw the product out. We are in the process of gather leftover product – about 40 opened and unopened bags – and having it tested for a broad range of toxins and chemicals. Hopefully between our tests and the testing being done by Daily Harvest and the FDA, we will figure out what is causing these illnesses, and what, if any, long-term impacts are of concern.

We have been retained by nearly 100 individuals who have suffered nearly identical symptoms – liver and gall bladder disfunction with exceeding abnormal liver function. Many have been hospitalized, undergoing numerous tests and procedures, including surgery.

GENERAL ALLEGATIONS

The 2022 Outbreak Linked to Daily Harvest French Lentil + Leek Bowls

3.1       According to the U.S. Food and Drug Administration, on June 19, 2022, Defendant Daily Harvest instituted a voluntary recall of approximately 28,000 units of French Lentil + Leek Crumbles produced between April 28 and June 17, 2022.
3.2       More than 470 instances of consumers experiencing illness or adverse reactions after consumption of the French Lentil + Leek Crumbles have been reported. The consumption of Defendant’s products has caused an array of serious health complications, from gastrointestinal illness to liver and gallbladder dysfunction.
3.3       Daily Harvest has stated that the approximately 28,000 units of the product were distributed to customers in the United States through direct online sale and through retail sales at stores in Chicago and Los Angeles. Daily Harvest also provided samples to a small number of customers and social media influencers.
3.4       The French Lentil + Leek Crumbles was a frozen, pre-made product packaged in a 12oz white pouch with the Daily Harvest logo at the top, “CRUMBLES” printed immediately below, and “French Lentil + Leek” printed in bold.
3.5       All lots of the French Lentil + Leek Crumbles product were ultimately recalled by the Defendant.

Facts Relating to Defendant’s Manufacture, Distribution, and Sale of Contaminated, Defective Food Products that Caused Plaintiff’s Injuries

3.6       On April 28, 2022, Defendant announced the launch of the “Crumbles” product line, including the now-recalled French Lentil + Leek Crumbles.   
3.7       Defendant marketed these French Lentil + Leek Crumbles as a convenient, pre-made item that, after sauteing, can be added to other products, including other those produced and marketed by the Defendant, for a complete meal. Defendant marketed the Crumbles as “planet-friendly to add more nourishing plant protein into” customers’ diets.   
3.8       Defendant’s promotional materials state (as quoted here) that a “team of chefs and nutritionists” created the French Lentil + Leek Crumbles recipe, and that the product was an “easy to prepare and ready in minutes” way to lower customers’ carbon footprint, and potentially “help you live longer.” 
3.9       Defendant claims to work directly with farmers to grow organic products and “increase biodiversity” while avoiding synthetic chemicals.
3.10     Defendant manufactures, packages, distributes and/or sells, directly all of its products, including the French Lentil + Leek Crumbles, to customers through online sales, through its own standalone retail stores in Chicago and Los Angeles. Additionally, Defendant provides samples to a small number of customers, including social media influencers, to increase visibility and, ultimately, sales of the products.
3.11     Plaintiff purchased through online subscription  Defendant’s French Lentil + Leek Crumbles and on two occasions consumed it. The product was contaminated and caused Plaintiff’s injuries described below.
3.12     The French Lentil + Leek Crumbles consumed by Plaintiff contained contaminated ingredients, manufactured, packaged, distributed and/or sold by Defendant.

On April 28, 2022, Daily Harvest announced the launch of Crumbles, a versatile plant-based crumble made entirely from real ingredients like lentils, nuts, seeds, and vegetables.

Of note, some “influencers” received the product earlier and became part of the statistics of the hundreds with severe liver disfunction.  A key question is when Daily Harvest was made aware of the mounting illness.

Since Monday we have been contacted by nearly 100 consumers who have suffered nearly identical symptoms.  Here is one example of a young woman who had her gallbladder removed yesterday:

Headache, nausea, vomiting, skin sensitivity and stomach sensitivity were also symptoms. The headache, nausea and vomiting accompanied the worst pain in the evening and lasted for several hours to a few days. Severe abdominal pain in the upper right quadrant. Right shoulder pain. Pain was sharp. The pain got worse over time and the first time it lasted for 72 hours. I had some stomach sensitivity though for 120 hours total. The second time I experienced intense pain for 120 hours and I am still feeling pain. The pain came on around 7 am on Sunday, May 29th and is ongoing although less severe right now. I am getting my gallbladder removed as a result. 

Here is another one:

I was recently hospitalized for 8 days, on the 3rd day considered for ICU admission and instead transferred to a tertiary care center 3 hours from home due to acute liver failure.  I had a 103 fever packed in ice for days, vomiting and severe stomach and rib pain.  My platelets, gallbladder, liver and neurological system were all effected.  As well, I am a nursing mother to a four month old baby girl.  Elevated Liver Enzymes (800+), gallbladder injury, kidney injury, fluid in ureters, dark urine, high billirubin, ketones in urine, fever 103F for 3 days, severe headache, pressure in base of skull, limited range of motion, sensitivity to light, double vision, abnormal reflex and neurological tests, confusion, dizziness, numbness in hands, feet and face, vomiting, nausea, severe abdominal pain, liver pain, frequency of urination, stopped menstruation, abnormal hormone levels, see labs attached for additional high and low lab reports, severely lowered platelets

According to the April 28, 2022, press release, “Consumers now have a people and planet-friendly way to add more nourishing plant protein into their diets. Crumbles offer 13 grams of protein per serving and are free of gums, fillers, hydrogenated oils, GMOs, or artificial anything. Just sauté, then add to tacos, pasta sauces, Daily Harvest Flatbreads, and more. Crafted by Daily Harvest’s team of chefs and nutritionists, Crumbles are launching in two mouth-watering varieties: Walnut + Thyme and French Lentil + Leek. Both are savory, herbaceous, and seasoned to perfection, yet versatile enough to use as a base for different recipes. The new collection is easy to prepare and ready in minutes, offering a simple way to integrate more nuts, seeds, legumes, and veggies into diets – and make a difference for the planet.”

However, after hundreds of customers reported – now likely over 500, Daily Harvest recalled the French Lentil + Leek Crumbles on June 23, 2022.

According to Daily Harvest, “From April 28 to June 17, 2022, approximately 28,000 units of the recalled product were distributed to consumers in the continental United States through online sales and direct delivery, as well as through retail sales at the Daily Harvest store in Chicago, IL and a “pop-up” store in Los Angeles, CA. Samples were also provided to a small number of consumers.

Consumer safety is our highest priority, and we have taken immediate steps to stop production and distribution of the product and conduct a root cause investigation, which is ongoing. This recall is being made in cooperation with the U.S. Food and Drug Administration.

According to the Washington Post: Daily Harvest, a service that offers home deliveries of vegan frozen food it claims is good for consumers and the environment, is grappling with allegations that one of its products sickened people. The celebrity-backed company is “working with a group of experts to help us get to the bottom of this” after complaints from customers who said they had experienced stomach, liver and gallbladder issues after eating its French leek and lentil crumble, enlisting the Food and Drug Administration, “microbiologists, toxin and pathogen experts as well as allergists” to identify any problems, it said in a note to customers posted Wednesday on Instagram.

“All pathogen and toxicology results have come back negative so far, but we’re continuing to do extensive testing and will keep you updated,” the company wrote in the post.

The company on Sunday said it had advised anyone who had purchased the product — a blend that includes lentils, butternut squash, quinoa, hemp seed and cremini mushrooms and was marketed as a crunchy plant-based topping — to dispose of it.

We have been contacted by nearly two dozen people who have been suffering a range of severe digestive issues, including liver complications. Many have been hospitalized, with some suffering ongoing symptoms. We have multiple samples of the French leek and lentil crumble out to labs for testing.
